We reserve the right to change these Terms and Conditions at any time. It is your responsibility to read the Terms and Conditions on each occasion that you use this website, and your continued use of the website shall signify your acceptance to be bound by the latest Terms and Conditions.

Order Process

All orders that you place with Southern Artificial Grass via the website or over the phone will be subject to acceptance in accordance with these Terms and Conditions.

Terms and Conditions

When you place an order, you are offering to buy the product(s) from us and we will send you an order acknowledgement. However, your order will only be accepted by us once your product(s) have been delivered to you. Until then we can decline to supply the goods – we will try to ensure that this never happens, however, we do reserve the right not to fulfil your order for any reason if, for example, we have made an error on the price or similar or we simply can’t get hold of the item you need. In the event of these circumstances, we will refund you the price you’ve paid to us. Please note that we reserve the right not to accept an order for any reason and we won’t be liable to you or anyone else in these circumstances.

Sometimes the product specifications from the manufacturer may change, in which case we will do our best to offer you a similar alternative. We may experience problems with the supply of certain products and may therefore supply a substitute of the same or better quality at the same price. If you are not happy with the replacement or substitute you can return it in accordance with our 14-day money back guarantee. Where applicable, you may cancel your order in accordance with your rights under the Distance Selling Regulations.

Cancellations

If you wish to cancel your order and the goods have not been delivered or cut, you can do so within 24 hours of placing the order by contacting us at info@southernartificialgrass.co.uk or by calling 02393 878250.

However, if an order has already been cut and or shipped, we will require you to pay the associated costs of returning the item to us before we will refund the purchase.

Damaged or Faulty Products

In the unlikely event that you receive faulty or damaged goods, please contact us within 14 days of your original order date, prior to cutting and/or fitting or the attempted fitting. We will then arrange for the faulty or damaged goods to be collected and replaced. If any ordered item is removed from its original condition (for example cut/fitted/installed or attempted install) we will be unable to replace or give a full refund for the item(s)

Please note that products may have a slight colour variation due to the product being manufactured in batches and this is not a fault

You have the right to return any product(s) you have purchased within 14 days of the original purchase date.  Should you wish to return the products you’ve had delivered, you will be charged a restocking fee of 30% of the returned product(s) value and you will need to arrange the return of the grass yourself

The product(s) should be returned unused, prior to cutting and/or fitting or the attempted fitting complete with all packaging. Returned products will be checked upon arrival and we’ll be in touch to confirm the product’s condition. Additional fees may apply for products returned in a damaged condition that hasn’t been noted to us in advance and in accordance with this policy.

 General Delivery Information

All orders are processed and shipped in the order that they are received. Standard delivery time is 3 to 7 working days. We make every effort to deliver goods within the estimated timescales, however delays are occasionally inevitable due to unforeseen factors and may increase around holidays and peak shipping seasons. We are under no liability for any delay or failure to deliver the products within the estimated timescales.

We only offer a curb side delivery, our 1-man delivery service is completed by a 3rd Party. They are unable to assist or move the product into your home. If you live in higher rise accommodation please be aware that the carriers will only deliver to the ground floor. We do not offer upstairs deliveries due to the health and safety risk. Please note that in some circumstances an item being delivered may be heavier than the driver is able to lift. In these cases it is a customer’s responsibility to ensure that they have sufficient equipment and personnel available at the point of delivery to assist with unloading of the vehicle or, alternatively be able to provide smaller cut down sizes for the product ordered that can be delivered to the kerbside and unloaded without assistance.

Risk of loss and damage of products passes to you on the date when the products are delivered or the date that the first delivery is attempted by us

Please note we strongly advise that you do not book your fitter or landscaper until you have received and checked your order, as we are not liable for any installation costs or lost wages.

If you need your order to be shipped to an alternative address to the billing address, please specify during the checkout process when the option is available. Although we will make every effort to amend mistaken delivery addresses after the order has been placed, we cannot be held responsible for late deliveries if the incorrect address has been specified in the checkout by the customer.

Sale Items

Only regular priced items may be refunded. Sale items cannot be refunded.

 Collection

Should you wish to collect your order directly from us rather than having it delivered please call us on 02393 878250 to place your order over the phone.

 Payment

We take payment from your preferred payment method as outlined on our website and at the time of placing your order. Goods are subject to availability. In the event that we are unable to supply the goods ordered, we will inform you of this as soon as possible. A full refund will be given where you have already paid for the goods. The price you pay is the price displayed on the product page of this website for your specified size(s) at the time we receive your order. While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

All prices are shown in £ sterling and include VAT (where applicable) at the current rates

Shipping Charges

Shipping charges will be calculated at checkout.

Roll Cutting

Orders placed can be cut from different rolls and can therefore differ slightly in their colour variation. If you require more than 1 cut that will be joined, please inform us upon placing your order and we will make every effort to ensure cuts are taken from the same roll where possible.

Roll Sizing

The width of your grass will always be specified during the selection process, however on rare occasions the manufacturer’s size may vary by a margin of up to approximately +/- 1.25% in width or length. All dimensions are in accordance with British Standards 3665 (1974)

We would always advise customers to take this into account when deciding on the measurements to purchase. We would always advise that if in doubt, buy slightly more than required rather than being disappointed if your order is slightly shorter than required. We cannot be held responsible for orders which are too short or too long within these standard manufacturing tolerances

Artificial Grass Warranties

This warranty is inapplicable (i) to products used for any purpose other than landscape purposes, (ii) to any damage during or on account of improper handling, storing, transportation, installations, or repairs unless the improper conducts are committed by Artificial Grass Company, or (iii) to the extent that any defect or damage is caused by:

 

Burns, cuts, accidents, vandalism, abuse, negligence or neglect

Drainage defects or deficiencies on the sub-base and/or its surrounding area

Wear or abrasion caused by an inadequate sub-base

Any harmful chemical reaction to the Product caused by infill materials

Use of improper footwear or sports equipment

The playing surface being used for the purpose other than for which it was designed and installed

Application of improper cleaning methods

Use of cleaning chemicals, herbicides or pesticides

Forces majeure or other conditions beyond the reasonable control of Southern Artificial Grass

Failure to properly maintain, protect or repair the Products

Japanese Knot Weed, Bamboo, Mare’s Tail, Tree Root Growth or any other horticultural external influence

Wild animal damage including Badgers, Moles, Foxes and any other non-domestic animal

Damage from Dogs, Cats, Rabbits or any other domestic pet

Reflection from mirrors and/or glass onto the product

Subsidence caused by ground movement and/or tree roots

Improper design or failure of the sub-base

 

All products are subject to normal wear and tear. Japanese Knot Weed, Bamboo, Mare’s Tail, Tree Root Growth or any other horticultural external influence

Wild animal damage including Badgers, Moles, Foxes and any other non-domestic animal

Damage from Dogs, Cats, Rabbits or any other domestic pet

Reflection from mirrors and/or glass onto the product

Subsidence caused by ground movement and/or tree roots

Improper design or failure of the sub-base

Southern Artificial Grass does not warrant against normal wear and tear.

Intellectual Property

You acknowledge and agree that the material and content contained within this website is made available for your personal, non-commercial use only and that you may only download such material and content for the purpose of using this website. You further acknowledge that any other use of the material and content on this website is strictly prohibited and you agree not to (and you also agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.

Liability and Indemnity

Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation, or any other liability which may not otherwise be limited or excluded under applicable law.

We will use reasonable endeavours to verify the accuracy of any information on the site but make no representation or warranty of any kind, express or implied statutory or otherwise, regarding the contents or availability of the site or that it will be timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs, or represents the full functionality, accuracy, reliability of the website we will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the website and we accept no liability of any kind for any loss, damage from action taken, or taken in reliance on material or information contained on the site.

We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent on negligent misrepresentations) or otherwise out of or in connection with the Terms and Conditions for any:

We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.

Miscellaneous Provisions

The contract between us shall be governed by the laws of England and any dispute between us will be resolved exclusively in the courts of England. English is the only language offered for the conclusion of the contract.

We have selected our products on the basis that they will be used for domestic use only.
